Residence Permit Renewal in Spain in 2026: Deadlines, Documents and Common Mistakes

Renew a residence permit in Spain in 2026: deadlines, documents, non-lucrative and work permit rules, TIE renewal, and common mistakes.

Residence permit renewal in Spain: deadlines, documents and common mistakes

Renewing a residence permit in Spain in 2026 depends on the exact type of authorisation you currently hold. A non-lucrative residence permit, an employee residence and work permit, a self-employed permit, family reunification residence and other immigration statuses do not all follow the same renewal rules.

Spain’s current Immigration Regulation, approved by Royal Decree 1155/2024 and applicable since 20 May 2025, changed several aspects of residence renewals. One of the most relevant points is that some renewed work permits can now be valid for four years, while non-lucrative residence is generally renewed for two years.

When should you apply to renew your residence permit in Spain?

For several of the main temporary residence permits, the renewal application must be submitted during the two months before the current authorisation expires. If the application is filed within this period, the validity of the previous authorisation is extended until the renewal procedure is decided.

For a number of renewal procedures, an application may also be submitted during the three months after the permit has expired. However, a late application may lead to administrative sanction proceedings. For that reason, the post-expiry period should not be treated as a normal extension of the filing deadline.

A Spanish residence permit is not one single procedure

People often use the terms “Spanish residency” or “residence permit” as if they referred to one document. Legally, however, your status may be a temporary non-lucrative residence authorisation, a residence and work permit, family reunification residence or another type of authorisation. Each route has its own renewal requirements.

It is also important to distinguish residence from estancia for studies. A student stay is not automatically the same as residence and has its own extension or modification rules.

Renewing a non-lucrative residence permit in Spain

A non-lucrative residence permit is renewed under Article 64 of the Immigration Regulation. The application should be filed during the two months before expiry. It may also be filed within three months after expiry, without prejudice to possible sanction proceedings for late filing.

For renewal, the applicant must continue to meet the relevant requirements. These include sufficient financial means, health insurance, schooling of dependent children of compulsory school age where applicable, payment of the relevant fee and actual and effective residence in Spain for more than 183 days during the calendar year.

The minimum financial requirement remains linked to IPREM: 400% of IPREM for the main applicant and an additional 100% of IPREM for each dependent family member. The exact amount should be checked at the time the application is prepared.

A renewed non-lucrative residence authorisation is generally valid for two years, unless the applicant is entitled to long-term residence or EU long-term residence.

Renewing an employee residence and work permit

A temporary residence and work permit for employed work (por cuenta ajena) is normally renewed during the two months before expiry. A filing within the following three months can also extend the previous authorisation until a decision is issued, although late filing may have sanction consequences.

Renewal does not always require the same employer to remain in place. The Regulation provides several possible grounds for renewal, so a change of employer, a period of unemployment or a new employment contract should be analysed against the specific requirements of Article 80.

Under the current Regulation, a renewed employee residence and work permit is generally granted for four years, unless long-term residence is appropriate. It allows work anywhere in Spain, both as an employee and on a self-employed basis.

Renewing a self-employed residence and work permit

A self-employed residence and work permit (por cuenta propia) follows similar general filing periods. Renewal may be based on continuation of the activity, with the authorities checking compliance with tax and Social Security obligations, among other possible renewal grounds.

The renewed self-employed permit is generally valid for four years unless long-term residence applies. It authorises both self-employed and employed work throughout Spain and in any sector of activity.

What documents are commonly checked for a residence renewal?

  • a valid passport or travel document;
  • your current TIE and the administrative decision under which your residence was granted;
  • the correct official application form for your specific renewal procedure;
  • proof of payment of the applicable administrative fee;
  • evidence of income, financial means, employment or self-employment, depending on the permit;
  • health insurance where required for the type of residence;
  • family documentation if the residence authorisation depends on family circumstances;
  • schooling evidence for dependent children where legally required;
  • information about absences from Spain where they may affect the application;
  • whether you may already qualify for long-term residence instead of another temporary renewal.

Can you renew after your TIE has expired?

In many of the main renewal procedures, the underlying residence authorisation can still be renewed if the application is filed within three months after expiry. That does not mean late filing is consequence-free: sanction proceedings may be initiated.

This is also why it is important not to confuse the TIE card with the residence authorisation itself. The TIE is the physical identity card that documents the administrative status; the legal renewal concerns the underlying residence authorisation.

Do you need a new TIE after the renewal is approved?

Yes, when your immigration status requires a TIE. After a favourable renewal decision, the new physical card must normally be requested in person. For the principal renewal procedures discussed above, the Regulation provides a one-month period from notification of the favourable renewal decision to request the corresponding TIE.

When should you consider long-term residence instead of another renewal?

If you have already accumulated the required period of legal and continuous residence, simply renewing a temporary permit may not be the most appropriate route. Depending on the circumstances, it may be time to assess eligibility for residencia de larga duración or EU long-term residence.

Five years of physical presence in Spain does not automatically mean that every period counts in the same way. The legal status held and the continuity rules should be checked before deciding which application to submit.

Common mistakes when renewing Spanish residency

  1. Using the wrong procedure because the applicant only identifies the document as a ‘residence permit’.
  2. Treating the three months after expiry as an ordinary deadline with no possible consequences.
  3. Failing to check whether long-term residence is already available.
  4. Relying on requirements that applied before the current Immigration Regulation came into force.
  5. Not proving sufficient financial means or health insurance where they are mandatory.
  6. Ignoring long absences from Spain that may affect the immigration status.
  7. Confusing renewal of the legal residence authorisation with renewal of the physical TIE card.
  8. Leaving document preparation until the final days and overlooking validity requirements for supporting documents.

Frequently asked questions

How early can I renew my residence permit in Spain? For several main temporary residence permits, the application may be filed during the two months before the authorisation expires. The exact rule must be checked for your specific permit.

Can I renew Spanish residency after it has expired? For many renewal procedures, filing is possible within the three months after expiry, but late filing can lead to sanction proceedings. Earlier filing is preferable.

How long is a renewed Spanish residence permit valid in 2026? It depends on the permit. A renewed non-lucrative residence authorisation is generally valid for two years, while renewed employee and self-employed residence and work permits are generally valid for four years unless long-term residence applies.

Can I work as both an employee and self-employed after renewal? Under the current Regulation, renewed employee and self-employed residence and work permits generally allow both employed and self-employed work throughout Spain.

Is TIE renewal the same as residence permit renewal? No. The residence authorisation is the legal status; the TIE is the physical card documenting that status. A favourable renewal is followed by the TIE application where required.

Do I need a new TIE after my renewal is approved? Yes, when your status requires one. For the main renewal procedures discussed here, the TIE is normally requested within one month after notification of the favourable decision.

What to check before you apply

Before filing, identify the exact name of your current authorisation, its expiry date, the correct renewal period, the evidence required for that route and whether a modification or long-term residence application may be more appropriate. Changes in employment, gaps in work, long absences, family changes and approaching five years of legal residence should all be reviewed carefully.

If you are unsure which renewal procedure applies to your case, reviewing your TIE together with the original administrative decision and your residence history is the safest way to identify the correct route before filing.
