EX-01 Form in English: Step-by-Step Guide for Non-Lucrative Residence in Spain

Need help understanding Spain's EX-01 form? Step-by-step English guide to the official form for non-lucrative residence, sections, requirements and common mistakes.

EX-01 form in English guide for non-lucrative residence in Spain

Spain's EX-01 is the official application form for temporary non-lucrative residence under Organic Law 4/2000 and Royal Decree 1155/2024. It contains the applicant's personal data, financial resources where applicable, representation, notification details and the type of application.

This English guide explains the official form but does not replace the current Spanish EX-01. For an initial non-lucrative residence application, the procedure is linked to the residence visa application filed through the competent Spanish consular office, so the current consular checklist should also be checked.

What is the EX-01 form?

EX-01 is titled “Solicitud de autorización de residencia temporal no lucrativa”. Non-lucrative residence allows a foreign national to reside in Spain without carrying out employment or professional activities. Under the current regulation, the initial authorization has a duration of one year, subject to the applicable requirements.

Before you start

Download the current EX-01 from the Spanish Ministry of Inclusion, Social Security and Migration. Use the official Spanish form even if you rely on an English explanation. Make sure names, passport details, addresses and other data match the supporting documents. For an initial application, check the competent Spanish consulate's current instructions.

Section 1 — Applicant details

Enter the applicant's identification and personal information exactly as it appears in the passport or identity documents. Pay particular attention to names and surnames, date and place of birth, nationality, passport number, address and contact information. Differences between the form and supporting documents can cause avoidable questions.

Section 2 — Family member holding the financial resources

The form contains a section for the family member who holds the economic resources when this is relevant. Do not complete it mechanically in every case. Its use depends on how the applicant's financial means are being evidenced and on the family situation.

Section 3 — Representative

If the applicant is acting through a representative, the representative's details are entered here. The existence and scope of representation must also be supported in the manner required for the procedure.

Section 4 — Address for notifications

This section determines where procedural notifications are to be sent. Check the address and contact details carefully. Incorrect notification information can create practical problems even when the rest of the application is complete.

Section 5 — Type of authorization requested

The EX-01 distinguishes between the relevant types of non-lucrative residence application, including initial authorization and renewal, and also reflects whether the applicant is the holder of the financial resources or a family member. Select the option corresponding to the actual procedure.

Financial means and health insurance

Completing EX-01 is only one part of the application. The regulation requires sufficient financial means and health insurance. As a general regulatory benchmark, the applicant must demonstrate monthly resources equivalent to 400% of IPREM, plus 100% of IPREM for each dependent family member, subject to the rules applicable to the case.

Initial application and renewal

For an initial non-lucrative residence authorization, the application is connected to the residence visa procedure before the competent Spanish consular office. The visa application entails the request for the corresponding residence authorization. Consular documentary checklists can vary, so the current instructions of the competent consulate should always be checked.

For renewal in Spain, the current regulation generally allows filing during the two months before expiry. Filing may also be possible during the three months after expiry, without prejudice to a possible sanction. Renewal requires continuing to meet the applicable requirements and, where relevant, school attendance obligations. Current rules also require real and effective residence in Spain for more than 183 days during the calendar year.

Practical completion rules

The official instructions state that the form should be completed in capital letters, with a black pen in block letters or typed, and submitted as an original and copy. Review all three pages before signing. Do not create a substitute English application form: keep the official Spanish EX-01 beside the English explanation and enter the information into the official document.

Documents to prepare with EX-01

The exact package depends on whether the application is initial or a renewal and on the applicant's circumstances. EX-01 itself does not prove funds, insurance or other substantive conditions. Those requirements are supported by separate documentation. This can include a valid passport, evidence of financial resources, health insurance, family documents where relevant, proof of representation and other documents required by the competent authority.

Final check before submission

Compare the EX-01 against the passport and every supporting document. Recheck the application type, notification address and representative details. For an initial application, follow the current consular checklist; for renewal, check the requirements in force in Spain on the filing date.

Common EX-01 mistakes

Common mistakes include using an outdated form, treating an unofficial English translation as the application form, selecting the wrong application type, entering information that does not match the passport, inconsistent notification or representation details, and assuming that a correctly completed EX-01 is enough without checking the substantive residence requirements.
