Temporary protection for Ukrainians in Spain: new requirement from August 2026 and documents
New requirement for Ukrainian temporary protection from 5 August 2026: who is affected, military-obligation evidence and required documents.
From 5 August 2026, an additional requirement applies to new applicants for temporary protection from Ukraine concerning proof that military obligations have been fulfilled or that the person is exempt, where applicable. This rule does not apply to people who already held temporary protection in a particular EU Member State on or before 4 August 2026 and continue to hold it there without interruption.
Who is affected by the new August 2026 requirement?
The new rule mainly concerns new temporary-protection applications after the provision entered into force. A person who already benefited from temporary protection on or before 4 August 2026 and keeps that protection continuously in the same Member State is excluded from this additional condition.
What must be proved?
Where relevant, the applicant must show that Ukrainian military obligations have been fulfilled or that a lawful exemption applies. The purpose is to allow the authorities to verify that departure from Ukraine was lawful in relation to those obligations.
What evidence may be accepted?
The EU decision states that lawful border crossing when leaving Ukraine or an exit stamp in the passport may serve as evidence of lawful departure. If that cannot be confirmed, an official document that is easy to verify may be required, either on paper or electronically, for example through Reserv+, confirming exemption or fulfilment of the relevant obligations.
Which standard documents are needed in Spain?
The Spanish temporary-protection procedure still requires a passport, identity document or travel document. Where family members apply together, documents proving family links may be required, such as marriage, birth or adoption certificates. Third-country nationals who previously held lawful residence in Ukraine may need additional evidence concerning safe and durable return.
Do existing beneficiaries need to submit new documents?
The new requirement does not mean that every existing beneficiary must reapply or provide new military-status evidence. The military-obligations condition does not apply to those who continuously retain protection granted on or before 4 August 2026 in the same Member State.
Practical check before applying
Before applying, check the date on which temporary protection was first granted, whether the status has remained uninterrupted, passport and border-exit evidence, and any documents proving fulfilment of or exemption from military obligations if the new rule applies to you.
