Employed Work and Residence in Spain

Preparation and support for employed-work residence applications, renewals and related modifications.

Quick answer

Initial employed-work residence is designed for hiring a third-country national in Spain for more than 90 days. Under the ordinary initial procedure, the employer starts the application.

Who may qualify

  • Foreign workers over 16 whom a Spanish employer intends to hire.
  • Employers able to meet contract, solvency and labour-market requirements where applicable.

Main requirements

  • A valid employment contract and compliance with employer requirements.
  • Compliance with the national employment situation or a statutory exemption where required.
  • Worker qualification for the position and compliance with general immigration conditions.

Documents

  • Employer documentation and evidence of capacity to meet obligations.
  • Signed employment contract.
  • Worker passport and qualification evidence.
  • Other evidence depending on the role and the application or exemption from the national employment situation.

How the procedure works

  • Under the ordinary initial route, the employer files the application in Spain.
  • After approval, the worker obtains a visa where required, enters Spain and is registered with Social Security.
  • The TIE is then requested within the applicable time limit.
